Welcome to Mi Bagina ("we," "us," "our"). These Terms of Service ("Terms") govern your access to and use of the Mi Bagina mobile application, website, and related services (collectively, the "Service").

By creating an account, accessing, or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. What Mi Bagina Is

Mi Bagina is a service designed to help parents, guardians, and caregivers coordinate informal playground meetups by sharing real-time check-ins, group membership, and related notifications.

Mi Bagina is intended for social coordination only. It is not a childcare service, supervision service, background-check service, emergency service, or location-tracking safety service. The app is not intended for use by children directly — it is designed exclusively for use by parents, legal guardians, and authorized caregivers.

2. Eligibility

You may use the Service only if:

• you are at least 18 years old, or the age of legal majority in your jurisdiction;
• you are legally able to enter into a binding agreement;
• you are using the Service on behalf of yourself or your household in a lawful manner.

You may only add children to the Service if you are their parent, legal guardian, caregiver, or otherwise authorized to manage and share their information.

3. Your Account

To use certain features, you must create an account. You agree to:

• provide accurate and current information;
• keep your login credentials secure;
• promptly update your information if it changes;
• be responsible for activity that happens under your account.

You may not share your account in a way that compromises security or misrepresents who is using the Service.

4. Children and Family Information

The Service allows users to add information relating to children, such as name, age-related information, group participation, and current playground check-ins. Exact dates of birth are never shared with other users — only the child's computed age is displayed to group members during check-ins.

You represent and warrant that:

• you have the right to provide and manage information for any child you add;
• the information you provide is accurate to the best of your knowledge;
• your use of the Service does not violate any custody arrangement, court order, privacy obligation, or other legal restriction.

Where the Service offers visibility or co-guardian settings, you are responsible for choosing the settings that fit your family situation.

We reserve the right to remove child data if we receive a credible claim that the user who added it lacks the authority to do so.

5. Groups and Invitations

The Service includes groups that may represent neighborhoods, schools, classes, or private circles. Users may create groups, join groups through invite links, and interact with group features.

By creating, joining, or managing a group, you agree that:

• you will only invite people who are appropriate for that group;
• you will not misuse invite links;
• you will not impersonate another family, child, or guardian;
• you will respect the privacy of other group members.

Group admins may have additional permissions, including managing membership, invite links, and certain group settings. We may remove, limit, or revoke group functionality if we believe it is being misused.

6. Check-Ins, Playground Listings, and Real-Time Information

Mi Bagina allows users to check in to playgrounds and show active visits to relevant group members. This information may be time-limited, may expire automatically, and may not always be complete, accurate, or current.

You understand and agree that:

• check-ins are self-reported by users;
• playground names and listings may be user-generated;
• people may leave without updating their status;
• notifications may be delayed, missed, duplicated, or inaccurate;
• the Service should not be relied on as a guaranteed real-time source of truth.

You are solely responsible for your own decisions about whether to go to a location, meet others, or rely on information shown in the Service.

7. Notifications

The Service may send push notifications and other communications, including:

• notifications when someone checks in;
• reminders asking whether you are still at a playground;
• membership or group-related updates;
• service or account-related notices.

You can manage some notifications through your device settings or within the app where available. You acknowledge that actual delivery of notifications depends on third-party platforms and device settings, and we cannot guarantee delivery.

8. Acceptable Use

You agree not to:

• use the Service for any unlawful, harmful, threatening, abusive, or fraudulent purpose;
• harass, stalk, intimidate, or endanger other users;
• use the Service to monitor, track, or expose someone without proper authorization;
• upload false, misleading, or defamatory information;
• create fake accounts, fake children, or fake groups;
• attempt to gain unauthorized access to the Service or related systems;
• interfere with the operation or security of the Service;
• scrape, copy, reverse engineer, or exploit the Service except as allowed by law;
• use the Service in a way that infringes privacy, intellectual property, or other rights.

We may suspend or terminate access if we believe you have violated these Terms or used the Service in a harmful or inappropriate way.

9. Safety Disclaimer

Mi Bagina is a convenience and coordination tool. We do not verify the identity, intentions, parenting status, or background of users. We do not supervise interactions between users, children, or families. We do not verify that playgrounds are safe, maintained, or suitable for children of any age.

You are solely responsible for:

• deciding what information to share;
• deciding which groups to join;
• deciding who to meet and where;
• supervising your children at all times;
• evaluating whether a playground, event, or meetup is appropriate.

Never use Mi Bagina as a substitute for parental supervision, emergency response, or independent judgment.

10. User Content

You may submit content to the Service, including profile information, child information, group details, playground names, check-ins, and other material ("User Content").

You retain ownership of your User Content, but by submitting it through the Service, you grant us a non-exclusive, worldwide, royalty-free license to host, store, process, reproduce, adapt, display, and use that content solely for the purpose of operating, improving, securing, and supporting the Service.

You are responsible for ensuring that your User Content:

• is lawful;
• does not violate the rights of others;
• is not misleading or harmful;
• is appropriate for a family-oriented environment.

We may remove or restrict User Content that violates these Terms or that we reasonably believe creates risk for users or the Service.

11. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and manage personal information.

By using the Service, you acknowledge that we may process personal information as described in the Privacy Policy.

12. Intellectual Property

The Service, including its software, design, text, graphics, logos, trademarks, and other content provided by us, is owned by or licensed to us and is protected by applicable intellectual property laws.

Except as expressly permitted in these Terms, you may not copy, modify, distribute, sell, lease, publicly display, or create derivative works from any part of the Service.

13. Third-Party Services

The Service may rely on or integrate with third-party services, such as authentication providers, push notification platforms, hosting providers, analytics tools, deep-linking tools, app stores, or mapping/location-related tools.

We are not responsible for third-party services, and your use of those services may also be governed by their own terms and privacy policies.

14. Availability and Changes

We may modify, suspend, or discontinue any part of the Service at any time, with or without notice.

We do not guarantee that the Service will always be available, uninterrupted, secure, or error-free. Features may change over time, including groups, invite links, check-ins, notifications, or playground-related functionality.

15. Termination

You may stop using the Service at any time. You may also delete your account through the Service where that option is available, or by contacting us if needed. When you delete your account, all your personal data is removed as described in our Privacy Policy.

We may suspend or terminate your access to the Service, with or without notice, if:

• you violate these Terms;
• we believe your use creates risk to other users, children, or the Service;
• we are required to do so by law;
• we discontinue the Service.

Sections that by their nature should survive termination will survive, including sections relating to intellectual property, disclaimers, limitations of liability, disputes, and enforcement.

16. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND THAT THE SERVICE WILL BE ACCURATE, RELIABLE, OR UNINTERRUPTED.

Without limiting the above, we do not guarantee:

• that check-ins or notifications are accurate or timely;
• that playground or group information is complete or correct;
• that users are who they claim to be;
• that the Service will prevent missed meetups, unsafe situations, or misunderstandings.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MI BAGINA AND ITS AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, GOODWILL, PROFITS, REVENUE, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF:

• the amount you paid us for the Service in the 12 months before the claim, or
• USD $50.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

18. Indemnification

You agree to defend, indemnify, and hold harmless Mi Bagina and its affiliates, officers, employees, contractors, and service providers from and against claims, liabilities, damages, losses, and expenses arising out of or related to:

• your use or misuse of the Service;
• your User Content;
• your violation of these Terms;
• your violation of any law or rights of another person;
• your sharing of information relating to children without appropriate authority.

19. Governing Law

These Terms are governed by the laws of the State of Israel, without regard to conflict of law principles.

Any disputes arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the courts located in Tel Aviv-Jaffa, Israel, unless applicable law requires otherwise.

20. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we may provide notice through the app, website, or other reasonable means.

Your continued use of the Service after updated Terms become effective means you agree to the updated Terms.

21. App Store Terms

If you download the app through Apple's App Store or Google Play, you acknowledge that Apple and Google are not responsible for the Service itself, its content, maintenance, support, or claims relating to it, except as required under their applicable terms.

You agree to comply with any applicable third-party platform terms when using the Service.
